Why do the entry conditions including the 90 in 180-day rule apply to British citizens visiting the British Overseas Territory of Gibraltar under the 2026 UK/EU Treaty?

Short answer

The UK and Gibraltar have always been separate immigration jurisdictions, and Gibraltar never formed part of the Common Travel Area. British citizens who are not registered Gibraltarians have long been limited to 3-month stays. The Treaty continues this as a 90 in 180-day rule, with time in the Schengen Area also counting.

Detailed answer

It is often not understood that the United Kingdom and Gibraltar have always been two entirely separate jurisdictions. That has not changed under the Treaty. Gibraltar does not form part of the United Kingdom, separate immigration laws apply in each, and Gibraltar is constitutionally free to adopt its own rules in this area.

Gibraltar has also never formed part of the Common Travel Area between the United Kingdom, Ireland, the Isle of Man and the Channel Islands. For this reason, there have always been immigration controls between Gibraltar and the United Kingdom. The Schengen arrangements change very little in this respect.

The position before the Treaty

British citizens have not had an absolute right to remain in Gibraltar indefinitely for a very long time. Since the 1960s, successive Gibraltar governments have treated British citizens who are not registered Gibraltarians and not resident in Gibraltar as EU citizens for immigration purposes. Under that regime, British citizens, like EU citizens, could remain in Gibraltar for up to 3 months. For longer periods, they were legally obliged to register and take up legal residence in Gibraltar.

The position since 15 July 2026

The Treaty has applied provisionally since 15 July 2026, and the position is not radically different. A British citizen visiting Gibraltar may stay for 90 days in any 180-day period. The main change is that time spent in Gibraltar and time spent in the Schengen Area now count together towards that limit.

Staying longer

Anyone who wants to stay beyond the limit must apply for residence in Gibraltar under the residence rules that came into force on 14 July 2026. Registered Gibraltarians and existing Gibraltar residents are not subject to the 90 in 180-day limit.
