What are the benefits that the 2026 UK/EU Treaty grants to holders of Gibraltar identity cards and Gibraltar civilian registration cards in relation to Schengen Area access?
Short answer
Holders can circulate within the Schengen Area for 90 days in any 180 days without a visa, and time spent in Gibraltar does not count towards that limit. They are exempt from passport stamping, the Entry/Exit System (EES) and ETIAS, and Spanish authorities cannot refuse them entry to Gibraltar.
Detailed answer
Since the treaty began to apply provisionally on Wednesday 15 July 2026, such persons have been able to circulate freely within the Schengen Area for periods of 90 days in any 180 days. They are not subject to any visa requirement for doing so, and time spent in Gibraltar does not count towards their Schengen entitlement. A series of special exemptions also applies. They are not required to have their passports stamped, and they are exempt from the Schengen Entry/Exit System (EES), which has been fully operational since Friday 10 April 2026. They are also exempt from the European Travel Information and Authorisation System (ETIAS). They are not required to justify the purpose and conditions of an intended stay in Gibraltar or to show sufficient means of subsistence. The Spanish authorities carrying out controls on behalf of the Schengen Area cannot refuse entry to Gibraltar to a holder of a Gibraltar identity card or to a person legally resident in Gibraltar who holds a blue, magenta or green civilian registration card. The EES exemption in practice Some residents have been registered in the EES despite the exemption. On Tuesday 13 October 2026 the Government of Gibraltar confirmed that the European Commission had issued further instructions to Schengen authorities that Gibraltar residents should not be registered or required to interact with the system. Residents with an EES record, including one created before Wednesday 15 July 2026, can request its erasure from the Schengen State that recorded their most recent entry into or exit from the Schengen Area.
