Education

Can children of cross-border workers or non-residents attend Gibraltar government schools?

Short answer

Free government schooling is tied to the child living in Gibraltar with a resident parent or guardian. Children who live in Spain are generally not entitled to a government school place even if a parent works in Gibraltar, and Category 2 status does not confer any entitlement to publicly funded schooling.

Detailed answer

Who is entitled

The Education and Training Act removes fees for government schooling for compulsory-age children who reside in Gibraltar. Proof of residence is required at enrolment, and the Department of Education checks eligibility for new and existing pupils.

Frontier workers and the 2026 treaty

The UK-EU treaty, provisionally applied from 15 July 2026, gives frontier workers' children equal access to education where the children reside in Gibraltar. Children living in Spain do not gain a place because a parent works in Gibraltar.

Category 2 and new residents

  • Category 2 status does not confer entitlement to publicly funded schooling (reaffirmed June 2026).
  • The residence framework for new applicants lists schooling for residents' children as a benefit, subject to meeting the criteria.

Fee-paying and private options

A limited number of fee-paying government places has been reported, without choice of school; confirm with the Department. Private schools (Loreto Convent, Talmud Torah, Prior Park) run their own admissions.
