Can Gibraltar companies operate across the EU?

Short answer

The issue of Gibraltar companies operating in the EU is a complex one based on a number of significant points that changed completely upon Gibraltar's departure from the EU at the end of January 2020. Gibraltar companies lost all rights to access the European Market following Brexit.

Detailed answer

As a result of specific negotiations, agreements and measures taken unilaterally by Spain and Gibraltar, some businesses continue to operate on a cross-border basis, in both directions. Any residual cross-border commercial activity involving the provision of services by Spanish companies in Gibraltar, as an example, will be prohibited from the point of implementation of the new Treaty between the UK and EU in respect of Gibraltar's relationship with the EU. As regards the 'fluidity of movement' of goods, there are measures set out in the Treaty whereby Gibraltar will form part of customs union/arrangement, the detail of which is not yet fully understood.
