Employment

If I live in Spain and work in Gibraltar, where do I pay tax?

Short answer

Both, with relief. Gibraltar deducts income tax at source through PAYE on work done in Gibraltar. As a Spanish tax resident you must also declare that salary in your annual Spanish IRPF return and claim the international double taxation deduction, paying Spain only the difference if Spanish tax on that income is higher.

Detailed answer

In both places, with relief in Spain.

Gibraltar

Gibraltar taxes employment exercised in Gibraltar at source. Your employer deducts PAYE and social insurance.

Spain

Living in Spain for more than 183 days, or having your centre of economic interests there, makes you Spanish tax resident and taxable on worldwide income. You declare your Gibraltar salary in the annual IRPF return (April to June).

Double taxation relief

Under article 80 of the IRPF Law you deduct Gibraltar tax paid, capped at the Spanish tax due on that income. If Spanish tax is higher, you pay the difference.

The 2019 tax agreement

  • In force since 4 March 2021.
  • Tie-breakers treat you as Spanish resident if, for example, you spend more than 183 nights in Spain or your only permanent home is there.
  • Provides for exchange of information between the two tax authorities.

The July 2026 treaty did not change tax residence rules.
