Under the 2026 UK/EU Treaty, how does the parliamentary carve-out affect state aid granted by an Act of the Gibraltar Parliament?

Short answer

The Treaty provides a limited carve-out for aid granted by an Act of the Gibraltar Parliament. Such aid is not subject to prior authorisation or mandatory recovery by the independent authority, but the authority may issue an opinion, and courts may declare incompatibility, prompting the UK to consider amendments.

Detailed answer

Articles 205, 206 and 207 create a specific regime for parliamentary acts:

  • The independent authority must be notified and may issue an opinion.
  • It cannot block or order recovery of aid granted by primary legislation.
  • Courts may only issue a declaration of incompatibility.
  • The UK, in respect of Gibraltar, must have regard to such opinions or declarations and may propose legislative changes.

The carve-out operates domestically. It does not prevent the EU from using the Treaty’s dispute settlement mechanism if it considers aid granted by Act of Parliament breaches the Treaty, and questions of EU law interpretation in that process are referred to the Court of Justice of the EU.

Status: the Agreement has been provisionally applied since 15 July 2026, pending formal ratification.
