How does the 2026 UK/EU Treaty in relation to Gibraltar allow people to travel between Gibraltar and the Schengen area?

Short answer

Since Wednesday 15 July 2026, people of any nationality can cross the land frontier between Gibraltar and Spain without routine border checks. Gibraltar remains outside the Schengen area, and Schengen entry checks are instead carried out at Gibraltar's airport and port.

Detailed answer

Article 30 provides that persons may circulate between Gibraltar and Member States applying the Schengen acquis without border checks. To compensate, arrivals at Gibraltar's airport and port from outside the Schengen area go through two checks: first Gibraltar entry controls by UK/Gibraltar authorities, then Schengen entry controls by Spanish border officers. Gibraltar residents cannot be refused entry by Spanish officers, are exempt from passport stamping, the EU Entry/Exit System (EES) and ETIAS, and may spend up to 90 days in any 180-day period in the Schengen area without a visa. In a Technical Notice of Tuesday 13 October 2026, the Government of Gibraltar confirmed that the European Commission had instructed Schengen authorities not to register Gibraltar residents in the EES, and set out how residents registered in error can have their records erased. Because there are no immigration controls at the land border, crossings there are not recorded in the EES. Non-residents who are not EU or Schengen nationals, including UK citizens not resident in Gibraltar, can be refused entry if they do not meet Schengen rules, and time they spend in Gibraltar counts towards their Schengen 90/180-day allowance. UK military personnel and their families are exempt from the Schengen border rules when entering Gibraltar.
