Can EU citizens still work in Gibraltar without a visa now the UK-EU treaty is in force?
Short answer
Yes. EU, EEA and Swiss nationals do not need a work permit to take a job in Gibraltar. EU citizens who live in Spain and commute in are frontier workers, with equal-treatment rights under the TGEU Implementation (Frontier Workers) Regulations 2026 and access to an official certificate of frontier worker status.
Detailed answer
Yes. EU, EEA and Swiss nationals do not need a work permit to work in Gibraltar. Only other nationalities require one, applied for by the employer through the Department of Employment.
What the treaty changed
The UK-EU Agreement on Gibraltar entered provisional application on 15 July 2026. Its frontier worker provisions were implemented by the TGEU Implementation (Frontier Workers) Regulations 2026, which apply to EU citizens legally resident in Spain who work in Gibraltar.
Frontier worker rights
- Right to take up and pursue employment under the same domestic law as UK nationals.
- Right to enter, stay and leave Gibraltar to register with employment services and look for work.
- Equal treatment with employed UK nationals legally residing in Gibraltar.
- Status can be retained during involuntary unemployment, illness or injury, and vocational training.
- No rights to housing in Gibraltar.
Certificate of status
The Director of Employment issues a certificate of frontier worker status on an online application via egov.gi, with a valid identity document and evidence of frontier worker status. It may be issued electronically and is renewable.
Living in Gibraltar
The treaty confers no automatic right of establishment. Moving to Gibraltar requires a residence permit.
