Will registered Gibraltarians living abroad have the same rights under the 2026 UK/EU Treaty in relation to Gibraltar?
Short answer
Yes. Persons who have been issued with a Gibraltar identity card but are not resident in Gibraltar benefit from the treaty rules to the same extent as Gibraltar identity card holders residing in Gibraltar, including exemption from the EU Entry/Exit System (EES).
Detailed answer
The Government of Gibraltar's Technical Notice of Tuesday 13 October 2026 confirms that holders of Gibraltar identity cards are covered irrespective of whether they reside in Gibraltar. A Gibraltarian living abroad who has been registered in the EES can therefore request erasure of the record in the same way as a resident, by contacting the competent authorities of the Schengen State that recorded their most recent entry into or exit from the Schengen Area and enclosing copies of their passport and the front and back of their Gibraltar identity card. Carry your passport and Gibraltar identity card together when crossing Schengen external borders, and present both to border authorities, as the card is what establishes your treaty entitlements.
