Does the Spanish election affect the European Parliament's vote on the Gibraltar treaty?

Short answer

No. The European Parliament's consent vote, indicatively set for Monday 14 December 2026, is cast by MEPs elected in June 2024, who stay in office whatever the result. The election matters for the final step in the Council of the EU, which must conclude the treaty unanimously, and where Spain is represented by whichever government is in office.

Detailed answer

The treaty has applied provisionally since Wednesday 15 July 2026. Completing it on the EU side takes two separate steps in two separate institutions. See our Spanish election tracker.

Step one: the European Parliament

  • MEPs, including those elected in Spain, were elected in June 2024 for five years. The Spanish election does not change who votes.
  • Indicative date: Monday 14 December 2026, which could slip to January or February 2027.
  • Tuesday 8 September 2026: six PP MEPs tabled an amendment asking Parliament to refuse consent.

Step two: the Council of the EU

  • The treaty is an association agreement, so the Council must conclude it unanimously. Spain, like every member state, has a veto at this stage.
  • An abstention does not block a unanimous decision; only a vote against does.
  • The Council can act quickly: for the UK–EU Trade and Cooperation Agreement, it concluded the agreement on Thursday 29 April 2021, the day after the Parliament's consent was announced.

Where the election matters

Spain's Council vote is cast by a minister of whichever government is in office. The new Congress must meet by Thursday 24 December 2026, and a Prime Minister is appointed only after an investiture vote; in 2023 that took from Sunday 23 July to Thursday 16 November. If the Parliament votes on schedule, Spain's vote would very likely be cast by the Sánchez government in a caretaker capacity. Caretaker governments routinely take part in the Council: Spain's acting government held the Council presidency in the second half of 2023. See what a caretaker government can do.

If the Parliament's vote slips into 2027 and a new government is in office by then, that government casts Spain's vote.
