Who can help if an incorrect EES record causes me to be refused entry to the Schengen Area?
Short answer
Contact the Government of Gibraltar immediately at [email protected] if you are refused entry and cannot persuade the border guard that you are exempt from EES. British nationals can also contact the nearest British Embassy or Consulate, or the FCDO's 24-hour consular assistance line on +44 (0)20 7008 5000.
Detailed answer
The Government of Gibraltar's Technical Notice of Tuesday 13 October 2026 addresses this situation directly. It typically affects Gibraltar residents who were registered in the EES and whose exit from the Schengen Area was never recorded, because there are no immigration controls at the land border with Spain. The EES may then show them as overstaying when they try to re-enter the Schengen Area elsewhere, for example on a flight from London to Paris.
At the border
Show your passport and your Gibraltar identity card or civilian registration card. Explain that Gibraltar residents are exempt from EES registration under the Agreement between the European Union and the United Kingdom in respect of Gibraltar, and that your exit from the Schengen Area was not recorded because there are no immigration controls between Gibraltar and Spain.
If entry is still refused
- Email the Government of Gibraltar at [email protected] straight away.
- British nationals who need assistance, particularly outside normal working hours, can contact the nearest British Embassy or Consulate.
- The FCDO's 24-hour consular assistance number is +44 (0)20 7008 5000.
Preventing the problem
The Government strongly encourages anyone with an EES record to ask the competent authorities of the Schengen State that recorded their most recent entry into or exit from the Schengen Area to erase it as soon as possible, ideally before travelling. Keep any confirmation or correspondence you receive, and report any refusal of an erasure request to [email protected].
